Terms & Conditions

Last updated: [date to be set at launch]

Draft notice (remove before launch): this page was drafted by an AI assistant based on how Roughout actually works, as a starting point — it is not legal advice, and hasn't been reviewed by a solicitor. Please have it properly reviewed before relying on it, especially the governing-law and liability sections, and fill in the bracketed placeholders below with your confirmed details.

1. Who this agreement is with

Roughout is provided by Julian A. Downes, trading as a sole trader ("we", "us", "our") — there's no separate registered company behind it. These terms apply to the Roughout website (roughout.co.uk), the free web-based diagram editor available on it, and the Roughout Mac app.

2. The web app

The web version of Roughout is free to use, requires no account, and is provided on a best-effort basis with no uptime guarantee — it runs on infrastructure we manage ourselves, not a commercially backed cloud service with a service-level agreement. We may change, suspend, or discontinue it at any time, though we'll try to avoid doing so without notice where practical.

You agree not to use the web app to store, transmit, or generate unlawful, infringing, or abusive content, or to attempt to disrupt, overload, or gain unauthorised access to the service or the infrastructure it runs on.

3. The Mac app

The Roughout Mac app is sold and distributed through the Apple Mac App Store. Your purchase is a transaction with Apple, governed by Apple's own terms of sale and the standard Apple Media Services Terms and Conditions — including refunds, which are handled by Apple, not by us directly. These terms cover your use of the app itself once installed, alongside Apple's own terms.

4. Your diagrams belong to you

Anything you create with Roughout — your diagrams, your .rout files — is yours. We don't claim any ownership or licence over your content. The web app doesn't store or log your diagrams on our servers (see our Privacy Policy for exactly what happens when you generate a shareable link) — saving and keeping track of your own files is your responsibility, not ours, which is a deliberate part of how the tool works rather than a limitation we'd like to fix later.

5. No warranty

Roughout is provided "as is" and "as available," without warranties of any kind, whether express or implied — including, to the extent permitted by law, any implied warranty of merchantability, fitness for a particular purpose, or non-infringement. We don't guarantee the web app will be uninterrupted, error-free, or available at any particular time.

6. Limitation of liability

To the maximum extent permitted by law, we won't be liable for any indirect, incidental, special, or consequential damages arising from your use of Roughout, including loss of data — again, since the web app doesn't retain your diagrams, keeping your own backups is on you. Nothing in these terms excludes or limits liability that can't lawfully be excluded or limited [e.g. for death or personal injury caused by negligence, or fraud — standard carve-out, confirm wording with a solicitor].

7. Changes to these terms

We may update these terms from time to time. If we make material changes, we'll update the "last updated" date above. Continued use of Roughout after a change means you accept the updated terms.

8. Governing law

These terms are governed by the laws of England and Wales [confirm — depends on where you're legally based/registered], and any disputes will be subject to the exclusive jurisdiction of the courts of England and Wales.
